Canvassing votes & swearing in
Tuesday May 19th in the council chambers at 6 PM the votes from the last election will be canvassed and made official. Then newly elected council members, Mick Phalen and Mike Lee will be sworn in as well as our Re-Elected Mayor pro-tem Phyllis Sanborn. It will be a GREAT night for our city. Please come and join the festivities that celebrate the citizens overwhelming victory.

LCPD, Hallisey is doing what Hallisey has always done, nothing. He thinks he is above a little elbow grease. He will sit back and wait for his next opportunity. Wether it is slamming the Mayor or going on a tare. Hallisey has become more and more out of touch with the needs of League City today. It showed in the past election.

If the swearing-in was illegal, so what? We'll hold another one. And another one. And we'll keep on holding them until it's "legal." They're fun. How much misery can Pat stand? The Obama piece was outrageous, my goodness they included my wife who had nothing to do with anything. She herself was a McCain supporter!!!
They slammed poor ole Tommy and Ed who have voting records of being Republicans.
It is no wonder by an overwhelmeing margin that the voters of League City got rid of Tommy Frankovich, Darlene Anene, Keith Dill and Barbara Meeks. How quick we forget!
Now Tommy has done more good for this city than all the above mentioned, he was the only Councilman who showed up prepared to debate the issues, agree with him or not, the guy worked his butt off for League City and will be sorely missed.
Best of Luck to the new group, the public will demand results, and most of you are not prepared to produce them.

Mr Phalen was kind enough to respond to an email I sent regarding the flooding. This was last week before he even took office.
That's the mark of a professional acting with integrity. Calling someone a POS is the mark of someone with anger and denial problems.
I read the post on the Chronicle blog and the first thing that came to mind was: I don't care if you are a Republican or a Democrat sitting on city council. I want someone who is looking out for the interest of the citizens of League City. As I said on a previous thread; more and more folks in League City are paying attention and all of the folks in League City government should pay attention to the will of the people! No one is going to get a free pass.
It seems Patty Cake has to keep deflecting accusations of sour grapes. Does it ever occur to him why?

I'm not on anyone's side in this strange argument. I have some questions that aren't quite answered yet. It's a matter of timing and procedure, not the results of the election.
But, something you said struck me as funny... "You can count and recount the votes..." Really? How do we recount electronic ballots? How do we, as a people, go back and confirm and reconfirm that the actual voice of the people was heard? Where is the evidence that points to a winner? 1s and 0s stored on a Windows box? Really?

No different than paper ballots, in my opinion. Each candidate or position is assigned a unique string of 0s and 1s, so they don't get mixed up. Add 'em up and weigh one against the others. No biggy. I presume each machine is a stand-alone terminal not tied to a mainframe, so any hacking would have to be done at the individual machine.
If one machine showed Pat to be the winner by a 93% margin, you'd know it either tilted or Pat got within proximity of it. But why would anybody bother? The Ca$H boys saw the writing on the wall and knew their time was up.
As to procedure, sure, some I may not have been dotted or T crossed. If it doesn't count, do it over. The end result is still a foregone conclusion, so the only point in arguing it is... well, sour grapes.

It's not quite that simple, unfortunately (when are computers simple, anyway?). Being an IT guy, having had a computer since before I was 10, working for and with IT security teams at NASA, and having years of practical experience, I can promise you that computerized voting systems cannot and must not be trusted unless very careful auditing of both processes and software takes place. As it is, that is not the case. I'd encourage you to read the whole thing, but the executive summary hits the high points about the problems held by the particular voting machines we use. I'm not suggesting that the results of our election are invalid or that tampering took place (that would be awful "sour grape"y of me), but I am suggesting that electronic voting is not something to take lightly or to trust blindly. (I could easily say similar things about paper ballots, and I do...) I'll be meeting with the Mayor about this topic next week. Transparent elections are the utmost cornerstone of democracy.

A spot on P&Z has been suggested to me before. First, I'm not even really sure how to go about getting on P&Z as our city website is pretty much void of info on how citizens can get involved. Second, don't you folks know how I feel about zoning? And you want me on the commission in charge of it?
I haven't quite figured out what I'll do next time around. Folks have asked me to run again, folks have asked me to get on P&Z, one even said I should run for Mayor... I'll decide soon enough. What's most important to me though is that if I run, I do it not for myself, but for the people. Evidence of support will have a large influence on my decision.

What an outrage, and a black eye on us all. My heartfelt condolences to the mayor and family, and a call for full investigation into the incident. First thing is we need to get the governor to redirect the Texas Rangers from protecting that lunatic and paranoid MUD district blowhard from the "menacing" Kemah mayor's jogging, to protecting OUR mayor from real and known threat.

I was asked to delete a certain post. I did that. What lcpd posted will not be removed unless I am specifically again asked about that post to do so. The individual involved will have to contact me personally again and I don’t think that will happen. Even if he does there will be more discussion about it then there was the last time.
The license plate was taken down and they have a suspect. The bonehead that allegedly (Everyone is innocent until proven guilty) assaulted the mayor will pay for his stupidity. If we were to convict on suspicion then we would all be no better that Ms. Hallisey, who told me she had all the evidence and names involved in a certain publication and was going to the DA with it. Hmmmm I wonder what happened there?

regardless of one's position on the last election, no one should ever desire harm on anyone.
There is an updated headline story on the Galveston Daily News website with additional details from the police indicating that this is just an isolated road rage incident.
Specifically, the other motorist is 17.

JC, last time city was embarrassed was when mayor lamb was convicted of theft and PH was "appointed" mayor and then booted out of office ! Surely you recall part of LC history? You make it appear as if though you were present during this altercation. And if you weren't, then how is it that you know all the details and you're able to determine who's lying and who's telling the truth?

If I read right, the bail was $10k, not one. Maybe (a) she knows better than anybody (except Pat Hallisey) that the brat is out of control and she wants him to stew in the slammer, or (b) some time in the clink adds to the appearance of his oppression and suffering. Could help his defense case.
If the bail was set at $10k, the bond should be $1k.
Maybe she's afraid that $8.8 mil might make her son a juicy target for a civil action?
There are now nearly 600 reader comments on the Hou Chron site. I had to stop with the first 10 or 15 pages, but one comment struck me:
"She's probably a member of an outlaw scooter gang that was just out cruising for trouble and picked these two lambs as her target!"
Speculation about this story (here and elsewhere) has gotten too far out of hand with far too much guess work coming from people who have no knowledge of what happened. It is time for us all to calm down and look at a few basic facts.
1) Benson hit or shoved Randall in the back with enough severity to cause injury. There are independent witnesses to this fact and it is not in dispute. No independent witnesses or evidence suggests an assault by Randall and none has been charged. There is medical confirmation of injury to Randall. From these facts, we can accurately infer that regardless of whatever confrontation may or may not have occurred, Randall was leaving the scene before the assault happened. (Remember; hit in the back.) In simple facts, at the time of the actual assault, Randall was taking the strongest possible action to avoid further confrontation. There is NO possible argument that Benson acted in self defense and the law accepts no other mitigation for committing an assault. There are independent witnesses to these facts and corroborating evidence. There is no unbiased witness to the contrary.
2) Why did his mother let him sit in jail overnight? Surely anybody who could afford to have their kid drive around in a Tahoe could afford the bond for bail money on this type of charge. Assuming she is the same Candace Ford who just won the lottery, it is hard to see how cash could be the problem. I won't make the obvious speculations, but this certainly is an odd behavior for a mother who has publicly tried to defend the actions of her son and repeated accusations against the assaulted party.
3) Why is Pat Hallisey doing all he can to stir this situation up even more? In the past few days he has sent countless emails and posts to various blogs and newspapers under his own name and various pseudonyms using all manner of convoluted logic attempting to make the mayor appear to be the guilty party in this case. Other than the well known fact that Hallisey holds an obsessive grudge against the mayor, what possible connection does he have to any of the parties and what possible knowledge does he have in this case? Just exactly what is Hallisey's involvement here?
I forgot to state that my previous post was a copy of my post to the GDN primarily in response to the rampant and irresponsible speculation that has been occurring there and on the Chronicle.

Change possible in city's legal representation
City Council will consider terminating the city's current law firm and hiring the law firm of a former city attorney on an interim basis during its meeting Tuesday night.
The item was placed on the agenda by new City Councilman Mick Phalen. It would terminate the services of Gregg & Gregg, P.C. and temporarily bring in the law firm of Ross, Banks, May, Cron & Cavin, P.C.
Dick Gregg Jr. has served as City Attorney since February 2007 when City Council voted to fire former City Attorney Arnold Polanco and his firm of Ross, Banks, May, Cron & Cavin, P.C. as the city's legal representation. Gregg Jr. had been city attorney prior to the hiring of Polanco.
If City Council fires Gregg & Gregg, P.C. and Ross, Banks, May, Cron & Cavin, P.C. is hired on an interim basis, Polanco would return as city attorney, Phalen said. Polanco unsuccessfully ran for City Council in May 2007.
Phalen said he is disenchanted with the way that Gregg Jr. became city attorney in 2007. Yet he said that Gregg Jr. has not done anything wrong.
"This is to undo a bad decision that was made in the past," Phalen said of Polanco's firing. "If you paid attention to my campaign that is what it was all about -- bad decisions in the past. This is one that we can correct."
Added Phalen, "This is pure principle. It has nothing to do with power, politics or anything. Let's reset some of the things that we can set back. Let's just reset them right now."
Gregg Jr. declined comment on Friday afternoon. When Mayor Toni Randall was asked if she is happy with his performance, she said, "Yeah really, I mean, I've only worked with him a year. I can see where they are claiming some conflict-of-interest. That's understandable. Oh well."
Phalen also has an agenda item for Tuesday's meeting that would direct city staff to issue a request for qualifications to fill the position of city attorney.
City Councilman Neil Baron also has an agenda item for Tuesday night's meeting that would direct city staff to evaluate the need of the city potentially hiring a full-time city attorney and full-time legal secretary as employees instead of contracting with a law firm for legal representation.
Should City Council vote on Gregg & Gregg, P.C. during its meeting Tuesday night, City Councilman Jim Nelson, who defeated Polanco in 2007, said he expects the firm to be terminated. He said he does not support bringing back Polanco.
"It gets a little tiring playing musical chairs with our city attorney," Nelson said. "It's ridiculous. Mr. Gregg has done a good job. As far as I know, he has not played politics and I'm sure we're going to go back into the situation where we start being sued again."

I'm surprised you think Nelson would support Polanco. In the same post, you quote him saying he doesn't, and I can think of reasons why.
Nothing wrong with the city hiring Scotto's attorney, and attorney-client privilege should continue to protect Scotto's interests even after Gregg jumped ship. But there is still that appearance thing that showed poor judgment on the city's part.
Next, replacement Polanco had to leave, not because of any such appearance of conflict, but perhaps because he was getting too close to something the city didn't want to see.
I agree with Nelson that the city is going to have more legal problems, no matter who they hire. They made a big mistake, and they don't want to discuss, settle or reverse it. So there will be a price to pay, and maybe no attorney can buy them out of it now.

I can only hope you are wrong about the second part of your opinion. I can certainly prove and attest to the fact the city has made a number of big mistakes.
The next few weeks will be most telling. Either the new era council will seek to undo and fix past wrongs or the city will continue on the course of an expensive litigation that is based on the faulty assumption the city did no wrong.
I am curious about statements made that Dick Gregg did nothing wrong. Would someone please explain Attorney Barbara Roberts statement about Attorney Gregg at the last P & Z meeting “He has recused himself and I am here to protect the city”.
P & Z member Bill Kounce raised probing questions about Attorney Roberts authority to represent the City. He spoke about requesting documents (by public information request) to answer the question and found no answers. Ms. Roberts gave no real answer except to say she was there at request of council.
A search of records shows no such action taken by council. More questions.
I hope I'm wrong too, and a shift in consensus (both on council and in the city attorney) brought on by the will of the people could change the whole picture. Regrettably, no agreement was reached on the city's position on discussing the lawsuit among its litigants. If Helfhand wants to keep playing it close to the vest, and dragging it out -- and now Roberts' suspicious involvement only muddies it more -- we could be in for more wrongful expense to the taxpayers.
As I expected, Jim Nelson and Neil Baron (not to be confused with me, Pat) opposed canning Dick G and rehiring Arnold P. In fairness, Dick may have recused himself before any wrongdoing. But Dick is not the problem now, if indeed he ever was. At worst, he may just have been working for snakes. Snakes have rights too, and a lawyer's gotta make a living, right?
Neil raised good points about replacing him, but the picture he painted suggested that RFQ procedure was subverted. That was a separate issue and was retained and protected, thanks to Mick Phalen's item. And Neil's own proposal regarding a full-time in-house attorney and paralegal only strengthens options. There's no cause for grandstanding on that.
Something different, a few thoughts for council regarding traffic:A couple of items came up on last night's (Tuesday, May 26, 2009) council agenda, both to strengthen our ties to HGAC and to partner with neighboring communities on a regional transportation “plan.” I use the term “plan” loosely.
Not more than few weeks ago, you heard some fella speak before council about years and years of studies, and seemingly endless streams of money poured into figuring out how to fix the traffic mess. Meanwhile, the city is officially recognizing 35,000 cars a day jamming FM518 from Palomino to the Five Point Disaster (the collision of FM518 with FM2094 and FM270) as being a “problem,” at the same time that it officially seeks to turn Main Street into a magnet (called a “destination corridor”) for yet more cars full of tourists on top of existing residents and workers.
The partnering idea dismissed any interest in Friendswood, Pearland or other parts west, where some of the traffic might be diverted or rerouted. Instead, League City wants close ties to uppity cities east, where traffic is already at overload and has nowhere farther east to push. Not one city among them was cited as having shown any significant progress in fixing its own growing traffic problems, yet we want to talk about a regional alliance with those people?
Why stop with just regional thinking? Why not go state-wide? TxDOT has already made clear that it's dominant “old school” thinking, which “leads” (another term I use loosely) TxDOT's overall mission, is to build roads, more roads and more roads, until one day the entire state is paved wall-to-wall with asphalt.
The guy who spoke about the folly of commissioning new studies called for using studies we've already paid good money for, no matter how obsolete they may be now, and doing something -- anything -- with them. Last night, you were shown maps of the Palomino Road vicinity that claim there's NO traffic mess now or in the foreseeable future. You want studies? You've already got every kind. Pick one you like, and go with it. More studies and more money for them (another $20 grand was proposed last night for item 10B), we DON'T need.
If you are so desperate that you spend a thousand dollars a day on a cop to direct traffic at an intersection that already has an approved traffic signal, how can anything else you do now be wrong? No, I'm not suggesting turning Main Street into a one-way OUT of town -- yet.
Congratulations to Tim Paulissen, League City's new Mayor Pro tem. Tim will serve our city well as Phyllis Sanborn did for two proud years.

I agree Mr. Baron is an annoying little guy. I do wonder why he has the need to remind everyone that "I am an attorney" and "the hardest working council member in Galveston County ?" A lttle guy with a big ego.
His circus side- show Tuesday night clearly earned him extra "re-elect me" points with Republicans.
Wish him well on this trek to Austin to appeal his alleged TEC's violations. Maybe he can remind the TEC panel that "i am an attorney" also.
Baron brings to mind the attorney ads on daytime tv - they are promoting their law firms.
NB is using his council position to promote his law business. No one should be allowed to promote his or her business from the dais.

I understand that many young drinking age individuals watch the council meetings and anytime that Mr. Baron says “I’m an attorney” they have to take a shot or “chug” a beer . So don’t take their fun away !!

Phalen On Wrong Foot About City Attorneys
At his first city council meeting, League City Councilman Mick Phalen showed his appreciation to Arnold Polanco for his election support in a shameful display of politics. Phalen led the ousting of Dick Gregg as the city attorney.
In 2007, while I served on the city council, the council members decided not to renew Polanco’s contract as city attorney because he was too politically involved in city politics. Just like he is now.
Phalen didn’t even have the courage to submit a Request for Qualifications before relieving Gregg of his duties. At least when the previous city council decided to choose another company for city attorney, we maintained the dignity of going through the proper policies and procedures.
If this is any indication of how Phalen conducts business, the city is in a serious predicament.
